Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- HQinternet: HQinternet, based at Zinkstraat 24 A1658, 4823AD Breda, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 70898545.
- Customer: The natural person or legal entity that enters into or wishes to enter into an agreement with HQinternet.
- Services: All products and services offered by HQinternet, including but not limited to web hosting, domain registration, VPS, dedicated servers, SSL certificates and related services.
- Agreement: Any arrangement or agreement between HQinternet and the customer, of which these terms and conditions form an integral part.
- Website: HQinternet's website, accessible via www.hqinternet.nl and www.hqinternet.co.nl.
Article 2 – Applicability
These terms and conditions apply to all offers, quotes, agreements and service deliveries by HQinternet.
Deviations from these terms are only valid if explicitly agreed in writing.
The applicability of any purchasing or other terms of the customer is expressly rejected.
If one or more provisions in these terms are void or annulled, the remaining provisions remain fully applicable.
Article 3 – Offers and Agreement
All offers from HQinternet are without obligation, unless explicitly stated otherwise.
An agreement is formed the moment the customer places an order via the website and HQinternet confirms it, or when HQinternet begins performing the service.
HQinternet reserves the right to refuse orders without giving reasons.
The customer guarantees that the information provided is accurate and complete.
Article 4 – Prices and Payment
All prices are in euros and exclusive of VAT, unless stated otherwise.
HQinternet reserves the right to change prices. Price changes are announced at least 30 days in advance.
Payment must be made in advance using the payment methods offered on the website (iDEAL, credit card, PayPal, bank transfer).
In the event of late payment, the customer is automatically in default and HQinternet is entitled to suspend or terminate service delivery.
In the event of late payment, the customer owes interest of 1% per month on the outstanding amount, as well as all judicial and extrajudicial collection costs.
Refunds of amounts already paid will not be made, unless otherwise stipulated in these terms or legally required.
Article 5 – Delivery of Services
HQinternet will make an effort to activate the services as quickly as possible after receipt of payment.
Hosting services are usually activated within 24 hours of payment.
Domain registrations depend on availability and the processing time of the relevant registry.
Stated delivery times are indicative and not strict deadlines.
Article 6 – Use of Services
The customer is responsible for the use of the services and the content stored or distributed through the services.
It is not permitted to use the services for illegal activities, including but not limited to:
- Distribution of malware, viruses or other harmful software
- Spam or unsolicited bulk email
- Phishing or fraudulent activities
- Infringement of intellectual property rights
- Distribution of illegal content
- DDoS attacks or other forms of network abuse
HQinternet maintains an Acceptable Use Policy that forms an integral part of these terms.
In the event of a violation, HQinternet is entitled to suspend or terminate service delivery immediately without refund.
Article 7 – Availability and Maintenance
HQinternet aims for 99.9% annual availability for all hosting services.
HQinternet is entitled to temporarily take the services out of use for maintenance, updates or improvements.
Planned maintenance is, where possible, announced at least 24 hours in advance.
HQinternet is not liable for damage resulting from maintenance or temporary unavailability.
Article 8 – Support
HQinternet provides technical support via the ticket system in the customer portal.
Support is available for technical issues related to HQinternet's infrastructure.
Support does not include help with developing websites, writing code, or resolving issues in third-party software.
Response times depend on the priority of the ticket, as described in the Service Level Agreement.
Article 9 – Backups
HQinternet regularly makes backups of hosting accounts for disaster recovery purposes.
These backups are intended as an additional service, not as a replacement for the customer's own backups.
The customer remains responsible at all times for making adequate backups of their own data.
HQinternet does not guarantee that backups are always available or complete.
Article 10 – Domain Names
When registering a domain, HQinternet acts as an intermediary between the customer and the relevant registry.
The customer is bound by the terms of the relevant registry.
The customer guarantees that registering a domain name does not infringe on the rights of third parties.
HQinternet is not liable for the loss of a domain name due to late renewal as a result of non-payment by the customer.
Transferring a domain name to another provider is possible after payment of all outstanding invoices.
Article 11 – Intellectual Property
All intellectual property rights to software, documentation and other materials developed or made available by HQinternet remain with HQinternet or its licensors.
The customer only obtains a non-exclusive, non-transferable right of use for the duration of the agreement.
The customer retains all rights to the content they provide.
Article 12 – Privacy and Data Processing
HQinternet processes personal data in accordance with the General Data Protection Regulation (GDPR).
HQinternet's privacy policy applies and forms an integral part of these terms.
If the customer processes personal data through HQinternet's services, the customer is responsible for GDPR compliance.
A data processing agreement can be entered into upon request.
Article 13 – Liability
HQinternet's liability is limited to direct damage and amounts to no more than what the customer paid HQinternet in the 12 months preceding the event causing the damage.
HQinternet is never liable for indirect damage, including but not limited to consequential damage, loss of profit, missed savings, loss of data or damage from business interruption.
HQinternet is not liable for damage caused by:
- Incorrect use of the services by the customer
- Unauthorized use of login credentials
- Actions by third parties, including hackers
- Force majeure
The customer indemnifies HQinternet against all third-party claims related to the customer's use of the services.
Article 14 – Force Majeure
HQinternet is not obliged to fulfill any obligation if prevented from doing so as a result of force majeure.
Force majeure includes: power outages, network outages, DDoS attacks, natural disasters, war, terrorism, government measures, strikes, and other circumstances beyond HQinternet's control.
If the force majeure lasts longer than 30 days, both parties have the right to dissolve the agreement.
Article 15 – Money-Back Guarantee (VPS)
New VPS services carry a 7-day money-back guarantee from the date of activation.
If the customer is not satisfied within this period, the customer may dissolve the agreement and request a full refund of the purchase amount, excluding any domain registration costs.
The money-back guarantee does not apply if:
- the customer has used the service in violation of Article 6 (including spam, illegal activities or violation of the Acceptable Use Policy)
- the customer has already used the money-back guarantee before
- it concerns a renewal, upgrade or downgrade of an existing service
A refund request must be submitted within the stated period via the customer portal.
Article 16 – Term and Termination
Agreements are entered into for the agreed period (monthly or annually) and are automatically renewed for the same period.
Termination must be done via the customer portal, observing a notice period of one month before the end of the current period.
After the 7-day money-back guarantee described in Article 15 has expired, no amounts already paid will be refunded upon termination.
HQinternet is entitled to terminate the agreement immediately in the event of:
- Non-payment by the customer
- Violation of these terms or the Acceptable Use Policy
- Bankruptcy or suspension of payment of the customer
Article 17 – Changes
HQinternet reserves the right to change these terms and conditions.
Changes are announced at least 30 days before they take effect, via email or the website.
If the customer does not agree with the changes, they may terminate the agreement effective the date the new terms take effect.
Article 18 – Applicable Law and Disputes
Dutch law applies to all agreements between HQinternet and the customer.
Disputes will be submitted to the competent court in the district where HQinternet is based.
Parties will first attempt to resolve a dispute through mutual consultation before resorting to court.
